Terms of Sale

Introduction

These Terms of Sale (“Terms”) set out the terms and conditions on which products are supplied to you as a buyer on deerab.com or on our mobile application (together, the “Site”). The owner and operator of the Site is Deerab Trade Inc. (“we”, “our”, or “us”). By placing an order on the Site, you agree to be bound by these Terms with immediate effect.

Order Acceptance

• Supplier of Record: Each product is sold either by Deerab or by the local/international seller identified on the product page.
• Acceptance: Your order is accepted when we send a written confirmation (e.g., email). If we cannot accept your order, we will inform you and you will not be charged, or any captured amount will be refunded.
• Availability: All orders are subject to stock and confirmation of price.

Pricing & Payment

• Prices: Prices shown at checkout include applicable charges as displayed. Taxes and shipping are calculated per your address and selected method.
• Payment Methods: We accept secure card payments via our payment processor. We may add or remove methods at any time without notice.
• Authorization: By placing an order, you authorize us and our payment partners to process your payment details for the order total.
• Errors: In case of pricing or descriptive errors, we may cancel part or all of the order and refund any amount paid.

Taxes

Applicable sales taxes (e.g., GST/HST, provincial taxes) are calculated based on your shipping address and added at checkout in accordance with Canadian law.

Shipping & Delivery

• Options & Fees: Shipping options, costs, and estimated delivery timeframes are shown at checkout. See our Shipping Policy for details.
• Risk & Title: Title and risk of loss pass to you upon delivery to the address you provided or upon pickup, as applicable.
• Multiple Shipments: Items in an order may ship separately. You will not be charged extra shipping beyond what is shown at checkout.

Cancellations

• Your Cancellation: You may cancel your order any time before it ships by contacting [email protected].
• Our Cancellation: We may cancel your order if payment fails, items are unavailable, information is incomplete, delivery is impossible, or if we detect fraud or bulk/multiple purchases.
• Refunds on Cancellation: Any payment captured for a cancelled item will be refunded to the original method.

Returns & Refunds

Returns are handled under our Return & Refund Policy. Please review eligibility, timelines, and instructions before sending any item back.

Products & Warranties

• Descriptions: We aim for accuracy, but minor variations in color, dimensions, or packaging may occur.
• Condition: New items are supplied as described. Any refurbished or used condition (if applicable) will be clearly identified.
• Manufacturer Warranty: Where offered, claims may be made directly with the manufacturer according to their terms.
• Disclaimer: Except as required by law, we provide products “as is” without additional warranties.

Bulk / Multiple Purchasing

We may reject or limit orders at our sole discretion where we detect bulk purchasing or multiple units of similar products being purchased that may impact fair consumer access or violate category limits.

Your Account & Conduct

• Keep your account details secure and up to date.
• Do not use the Site for unlawful or prohibited activities, including the sale or purchase of restricted items.

Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, loss of profits, or data, arising out of or related to your use of the Site or purchase of products. Our aggregate liability for any claim related to a purchase shall not exceed the amount paid for the product giving rise to the claim.

Governing Law

These Terms are governed by the laws of the Province of Alberta and the applicable laws of Canada, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts of Alberta.

Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on the Site. Your continued use of the Site after changes are posted constitutes acceptance.
